Privacy Policy

1.About this policy

1.1 Discount Building Material Pty Ltd (“DBM”, “we”, “us”) distributes wholesale building materials to resellers and trade customers through the DBM portal. This policy explains what personal information we collect, how we use and disclose it, and the choices you have.

1.2 This policy is written to align with the Privacy Act 1988 (Cth), the Australian Privacy Principles and, where it applies to commercial credit, Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code. It should be read together with our Terms & Conditions of Trade (in particular clause 23) and the Deed of Guarantee & Indemnity.

2.What we collect

2.1 Depending on how you deal with us, we may collect:

• (a) Business details — legal entity name, ABN, entity type, GST and trust status, trading and billing addresses, industry and credit amount requested;
• (b) Contact details — names, positions, email addresses and phone numbers of your primary and billing contacts;
• (c) Director and guarantor details — full name, date of birth, residential address, email, phone, and driver licence number, card number, state and expiry date;
• (d) Trade references — the supplier names and contact details of your trade referees;
• (e) Credit information — credit reports and credit-related information obtained from credit reporting bodies, trade referees and other credit providers;
• (f) Signatures — electronic signatures and signing records for applications, acknowledgements and guarantees;
• (g) Account and order information — orders, deliveries, invoices, payments and account history; and
• (h) Technical information — the web page an application was submitted from and your browser type, recorded when you submit a form on this site.

2.2 If you do not provide the information we request, we may be unable to process your application or provide credit or Goods to you.

3.How we collect it

3.1 We collect most personal information directly from you, for example when you complete our credit application form, sign documents electronically, place an order or contact us.

3.2 We may also collect information from third parties, including credit reporting bodies, your nominated trade referees, other credit providers and public registers such as ABN Lookup and ASIC. When an applicant provides details about a director, guarantor or referee, the applicant should make sure that person knows their information has been given to us and has seen this policy.

4.How we use it

• (a) To assess applications for trade credit and the credit worthiness of customers and guarantors;
• (b) To verify identity and prepare, send and record the signing of credit applications and guarantees;
• (c) To supply Goods, arrange delivery, issue invoices and take payment;
• (d) To manage your account, monitor credit limits and collect overdue amounts;
• (e) To enforce our Terms & Conditions of Trade and any guarantee;
• (f) To tell you about our products and services, unless you have opted out; and
• (g) To comply with our legal obligations, including tax and record-keeping requirements.

5.Credit reporting

5.1 With the consent given in the credit application, we may obtain a credit report about the Customer and any Guarantor from a credit reporting body, and exchange information with trade referees and other credit providers, to assess the application, monitor credit worthiness and collect overdue accounts.

5.2 We may give information to a credit reporting body so it can create or maintain a credit information file, including information about defaults where payments are overdue.

5.3 You may ask a credit reporting body not to use or disclose your credit reporting information if you believe on reasonable grounds that you have been, or are likely to be, a victim of fraud.

6.Who we share it with

6.1 We share only what is needed for the purposes above. This may include:

• (a) credit reporting bodies, trade referees and other credit providers;
• (b) our Related Bodies Corporate;
• (c) suppliers, manufacturers and delivery providers who fulfil your orders;
• (d) our solicitors, accountants, debt collectors and mercantile agents;
• (e) service providers who host our website, portal, databases, document storage, electronic signing and email; and
• (f) government agencies and others where required or authorised by law.

6.2 We do not sell your personal information.

7.Overseas disclosure

7.1 Some of our cloud service providers may store or process information on servers located outside Australia. Where this happens, we take reasonable steps to ensure those providers handle your information consistently with the Australian Privacy Principles. We do not disclose credit reporting information to credit reporting bodies outside Australia.

8.How we store it

8.1 Your information is held electronically with our cloud providers, protected by access controls and encryption in transit. Access is limited to staff and contractors who need it for their role.

8.2 Account, credit and financial records are retained for at least seven years in line with Australian Taxation Office and corporate record-keeping requirements. We keep information only as long as we need it for the purposes above or as the law requires, then securely destroy or de-identify it.

9.Access & correction

9.1 You can ask what personal information we hold about you, and ask us to correct information that is inaccurate, out of date or incomplete. We will respond within a reasonable time, usually 30 days. We may decline access in limited circumstances allowed by law, and will tell you why.

10.Complaints

10.1 If you have a concern about how we have handled your personal or credit information, please contact us first using the details below. We will acknowledge your complaint within 7 days and aim to resolve it within 30 days.

10.2 If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.
